Terms of Service--Conditions of Sale:
The following General Conditions concern the purchase of products and services, carried out remotely through the internet on the website www.lalampadashop.it and pertaining to La Lampada S.r.l., Viale delle Industrie, 4/B 20037 Paderno Dugnano (MI), Italy, VAT ID IT00821900966 - C.F. 06295550153 - C.C.I.A.A. 1087924 - N. mecc. M/9714399
1) Acceptance of the Terms and Conditions of Sale
1.1) The contract stipulated between La Lampada S.r.l. and the customer shall be concluded with the acceptance, even partial, of the order on the part of La Lampada S.r.l. according to the procedures described in points 2.2, 3.1, 3.2. Carrying out an order with the procedures provided, the customer will declare to have read all the information provided to him during the procedure of purchase, and to fully accept the terms and conditions of payment described below.
1.2) If the customer is a consumer (namely a physical person who purchases merchandise for purposes not related to his professional activity) once the online purchase procedure is complete, he should print or save an electronic copy and keep these terms and conditions of sale, in compliance with the provisions of articles 3 and 4 of the D.Lgs 185/1999 on long-distance selling.
1.3) The customer is not entitled to damages or compensation, despite any contractual or extra-contractual responsibility for direct or indirect damages to persons and/or things, caused by lack of acceptance or avoidance, even partial, of an order.
2) Method of Purchase
2.1) The customer can order only the products listed in the electronic catalogue of La Lampada S.r.l. at the time that the order is placed and viewable online at the web address (URL) http://www.Lalampadashop.it, as described in the relevant information page. It is understood that the picture accompanying the description of a product may not be perfectly representative of its characteristics and may differ in color, dimensions, and product accessories present in the figure.
2.2) The correct receipt of the order is confirmed by La Lampada S.r.l. through an email response, sent to the email address provided by the Customer. The response is generated automatically by the system and cannot be considered as acceptance of the order, but only confirmation of receipt of the order.
2.3) The message of confirmation will show the date and time of when the order was placed and a 'Customer Order Number' to use in any further correspondence with La Lampada S.r.l. The message contains all of the data entered by the customer, who agrees to verify the correctness of this information and promptly notify us of any corrections that need to be made, according to the procedures described in this document.
The order confirmation will be sent by mail as soon as the order itself has been verified.
3) Order Status:
3.1) The status of the order is viewable only by the customers registered in the section "Customer Area" of www.lalampadashop.it
3.2) The total or partial non-acceptance of the order will be communicated by mail.
4) Method of Delivery
4.1) La Lampada S.r.l. ships orders for delivery worldwide using shipping services selected by destination.
4.2) For every order placed, La Lampada S.r.l. will create an invoice of the materials shipped, attaching it to the packaging of the order, pursuant under article 14 D.P.R. 445/2000 e DL 52/2004. The invoice will be issued based on the information provided by the customer when the order was placed. No changes to the invoice will be made after the invoice has been issued. It is not possible to obtain separate invoices for single products included in a given order.
4.3) Delivery costs, if applicable, are charged to the customer and made clearly apparent at the time that the order is processed. Payment for the merchandise on the part of the customer will be processed according to the payment method chosen during the order. Nothing more is owed by the customer with respect to the total of the order unless otherwise agreed and confirmed by the customer (e.g. adding products to the order).
4.4) La Lampada S.r.l. takes no responsibility if the delivery of the order is delayed.
4.5) Unless otherwise specified by the customer, delivery is carried out at the base level of service. At the moment of delivery of the merchandise by the delivery service, the customer is expected to confirm:
1) If the number of packages delivered corresponds to that indicated in the invoice.
2) The identity and quality of the products, listed on the invoice.
The invoice is located in the envelope attached to the outside of one of the packages.
Any errors in the number of packages or particulars, as well as the loss or damage of a package, must be reported immediately to the deliveryman; the returned merchandise must be returned with the words "received with damages" or "refused merchandise" in writing; once the document of the delivery service has been signed, the customer cannot make any protest with regards to the exterior characteristics of the delivered packages.
5) Cancellation and Refunds
5.1) The customer can cancel the order prior to shipping. Once the order has shipped, you may return according to the rules and regulations prescribed by law.
5.2) All purchases made long-distance and forwarded through phone or mail, since they occur outside of business premises, are subject to D.Lgs n. 185 del 22/05/1999 which, transposing the CE directive, provides for the possibility on the part of the purchaser to exercise the right of cancellation or return, except in special cases, previously agreed between the parties through an exchange of mail, fax, or other written communication. The right of refund applies to consumers and individuals that act for purposes that are unrelated to the commercial activity itself (those who purchase for non-professional purposes, i.e. without VAT). This does not apply to professional business customers (those who purchase for purposes related to business, i.e. with VAT).
5.3) The right to cancel or return applies to all products that are unused and in its original packaging. This does not apply in the case of goods made to specifications or which are clearly personalized for the customer (with special finishes) or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.
5.4) The intention to cancel, according to the law, must be communicated by registered mail within 14 days of purchase. In order to offer faster service, La Lampada s.r.l. accepts notices of cancellation sent by e-mail or fax (02-9904-1978). Before returning we ask that you contact us in order to receive a RMA (return merchandise authorization) necessary for the return.
Send the products to be returned in their original packaging, writing on the package the RMA number. Our address is La Lampada S.r.l., Viale delle Industrie, 4/B, 20037 Paderno Dugnano (MI) Italy. Attach a copy of your invoice and a note indicating the products and quantities returned, the wire transfer by which to obtain the credit of charges incurred by the related costs if incurred (Cod. ABI - CAB - Checking Account Number) and if the account holder is different also attach your own and its authorization.
5.5) Return shipments having no copy of the notice of intent to exercise the right of cancellation, or at least having no copy of the invoice or the RMA number on the packaging will not be accepted by the warehouse of La Lampada S.r.l.
We will not accept cash on delivery or with expenses paid by us.
5.6) If the above procedure is successful (maximum of 30 working days from receipt of goods), La Lampada S.r.l., will credit to the customer that which they paid in the invoice, excluding shipping costs (art. 5, paragraph 6, of Legislative Decree no. 185 of 22/05/1999), in the case of consignments covered by foreign countries outside the EU, any customs duties payable for the return of products will be charged to the customer. Refunds of orders whose payment method is bank transfer are performed solely by bank transfer, refunds of orders whose preferred payment method is by credit card are made solely by crediting the payment by credit. Customers are asked to not use credit cards that will expire soon.
5.7) In options trading (the cd. promotions), in which the purchase of an asset is combined with another product which is sold at a nominal price or given away, the right of cancellation will be legitimately exercised with the return of both goods purchased, given the constraint of the asset with a promotion with respect to the first. In the case of promotions that include two or more goods and for which the promotion and therefore the special price or particular discount applied exists due to a combined purchase, the right of cancellation is exercised on all the goods covered by the promotion.

7.1) All products sold by La Lampada S.r.l. are covered by the manufacturer's standard warranty and 24-month warranty for defects, according to DL 24/02. To use the warranty, the customer must provide the original invoice as proof of purchase.
7.2) The manufacturer's standard warranty is provided in the manner described on the site or in the documentation included in the packaging of the product. If, following inspection by an authorized service center, the manufacturer or La Lampada S.r.l., finds that the defect is not covered by the manufacturer's warranty, the customer will be charged for any costs of verification and recovery, as well as the costs of transport if supported by La Lampada S.r.l.
7.3) The guarantee of 24 months according to DL 24/02 applies to products that present a lack of conformity, provided that the product is used correctly, respecting its intended use and as provided in the technical documentation. This guarantee is for private consumption (a person who buys goods for purposes not related to his professional activity, or making a purchase order form without indicating a reference to VAT). In case of lack of conformity, La Lampada S.r.l. provides, without charge to the customer, the restoration of conformity by repair / replacement or reduction of the price, until the termination of the contract. If, following inspection by an authorized service center, the manufacturer or La Lampada S.r.l., finds that the defect should not be a lack of conformity in accordance with Decree 24/02, the customer will be charged for any costs of verification and recovery, as well as transportation costs if incurred by La Lampada S.r.l.
7.4) The replacements in the case of DOA (Dead On Arrival: product not working on delivery) takes place only if expressly provided by the manufacturer. The timing of replacement or repair of any product depends solely on the policies of the manufacturer.
7.5) If, for any reason, it is not possible to provide the customer a product warranty (repaired or replaced), La Lampada S.r.l. will proceed at its own discretion to refund the amount paid or to replace it with a product of equal or superior characteristics.
7.6) La Lampada S.r.l. will take no responsibility for any delays in repairs or replacements.
7.7) In instances where the warranty provides for the return of the product, you must contact by mail or telephone La Lampada S.r.l., and an operator will provide all the necessary information. When calling, please have available the purchase information (invoice, receipt, warranty certificate) issued by La Lampada s.r.l. La Lampada S.r.l. reserves the right not to provide guarantee to the product in the absence of the relevant purchase information or guarantee certificate. The operator will issue a RMA (Return Merchandise Authorization) to be affixed to the outside of the package used for the return. Consignments of the RMA number on the package will not be accepted by the warehouse of La Lampada S.r.l. The goods must be returned by the customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc.); to limit damage to the original package, we recommend that it be placed in another box or packaging used for shipping; the attachment of labels or tape directly on the original product packaging should be avoided in all cases.
7.8) Any work performed by unauthorized personnel from La Lampada S.r.l. will immediately void the warranty.
7.9) Warranty service does not change whatsoever the period of the warranty of the product.
7.10) The warranty is void in cases where product failure is caused by improper use, incorrect installation, servicing, maintenance or repair by technicians not authorized by La Lampada S.r.l.
8) LIMITATION OF LIABILITY- DISCLAIMER
8.1) INFORMATION ON THIS SITE: We try to keep this site updated as much as possible. But by the very nature of the products and the continuing commitment by producers to achieve higher and higher quality standards, we cannot guarantee that the information and images are those that best describe the products.
Although prices, descriptions, images, applications, and all the information on this site is correct, they may contain errors, inaccuracies, errors of publication, and may be updated at any time, for which La Lampada S.r.l. cannot be held liable.
8.2) The sales contract between the customer and La Lampada S.r.l. is concluded in Italy and governed by Italian law. For the solution of civil and criminal controversies, the jurisdiction is
exclusively that of the Forum of Milan.
For every order placed La Lampada S.r.l. invoices the materials shipped, attaching it to the packaging of the order, in accordance with Article 14 of Presidential Decree 445/2000 and DL 52/2004. For the issuance of the invoice, we depend on the information provided by the customer. No change in the invoice will be possible after the issuance thereof.
It is not possible to obtain separate invoices for individual products contained within a single order.
Italy and EU countries: the prices of the site are displayed including VAT.
All the rest of the world: the prices are excluding VAT.
For all destinations within Italy and the EU the applicable prices are VAT included. If the destination is different from that recognized automatically, enter the new destination in the appropriate fields on the screen.
EU citizens have to pay the VAT (value added tax) applied by the state in which they are making their purchases; if the destination of purchased goods is in Italy or the EU, the price is always VAT included, but if a purchase is made with a state destination outside of Europe (eg Switzerland) the price is excluding VAT.
Does this mean that non-Europeans pay less? Absolutely not! By paying the price without VAT at La Lampada S.r.l. and paying customs duties and the VAT of your given country, the final price will be more or less equal to the price including VAT, depending on the fiscal policies of the country of destination of the goods. You cannot ask for the change of the VAT system after the issuance of the invoice.
Non-EU citizens (eg Swiss) wishing to receive the order in Italy and then export it outside the EU must specify when ordering, paying by credit card the amount inclusive of the VAT, and presenting your purchases to the Italian customs with the goods and the original invoice (invoice excluding VAT), and return to us within 30 days of when the original invoice was stamped and endorsed by the Italian Customs. Upon receipt of the invoice we will refund the VAT paid in advance by crediting the credit card.
